Ethen Studio Media, Likeness & Generated Content
Version 1.0 describes how Ethen works today. It has not yet taken effect: passages shown in italics are still being decided, and the document will show an effective date once it is final. Earlier text is listed in the version history.
This policy sets the rules for creating and uploading images, video and audio in Ethen Studio. It covers your right to upload material, copyright and trademarks, the likeness and voice of real people, consent, synthetic media, characters and personas, public figures and minors. It also explains how Studio processes media through third-party providers, and how sharing, export, retention and infringement reports work. It applies to everyone using Ethen Studio at studio.upcube.ai, and it forms part of the Terms of Service. Voice-specific rules are in the Voice Consent Policy and Voice Cloning Policy policies.

Ethen Studio today
Ethen Studio is an early-access product for generating and organizing images, video and audio. It offers a catalog of generation models, a canvas, projects, history, review links and exports. Features in Studio may change, be limited or be withdrawn while it is in early access, as the Terms of Service explain.
What you bring to Studio
Prompts and settings
Your prompts and generation settings are sent to the provider of the model you choose, as described in How Studio processes media, and saved in your Studio history.
Uploaded images, video, audio and brand assets
Studio lets you upload reference media, such as images, audio clips, video, logos and brand assets, to guide generation. Before an upload is accepted, an automated scanner checks it. If the scanner is unavailable, Studio refuses the upload rather than accepting it unchecked. No scanner is configured today, so uploads to Studio are currently turned off. When uploads are turned on, accepted uploads will be stored in private storage linked to your project.
Your right to upload
Upload only material you have the right to use for the purpose you are using it for. Before you upload something, you must:
- own it, or have a license or permission that covers using it with AI generation tools;
- have the consent of any identifiable person shown or heard in it, where the law or this policy requires consent;
- make sure that uploading it does not break an agreement you are bound by, such as a confidentiality obligation or a stock-media license that prohibits AI use.
Upcube does not check who owns uploaded material. You are responsible for having the rights you need.
Brand assets
You can upload logos, product images, fonts and brand guidelines to keep generated work on brand. Upload only brand assets you own or are authorized to use, such as your own company's, or a client's with their permission. Generated media that features another company's brand must not suggest endorsement, sponsorship or affiliation that does not exist.
Copyright and trademarks
You must not use Studio to infringe others' intellectual property. In particular, do not:
- upload copyrighted works you are not authorized to use;
- generate content designed to copy a specific copyrighted work, or to pass off your work as another creator's;
- use trademarks or brand assets in ways that suggest an affiliation or endorsement that does not exist, or that confuse people about the source of goods or services.
Generated media can resemble existing works even when you did not intend it. Check important outputs before you publish or commercialize them. The Terms of Service explain how rights in Outputs are allocated.
Real people: likeness, voice and consent
Studio can generate realistic images, video and audio of people, including from reference media of real people. Using a real person's face, body or voice raises rights of publicity, privacy and dignity, and in many places it is regulated by law.
You may create or upload media depicting an identifiable real person only if:
- you are that person; or
- you have that person's consent, given freely and covering the kind of use you intend, or permission from someone legally entitled to give it; or
- your use is clearly permitted by law, such as genuine commentary or news reporting, and does not violate the prohibitions below.
Characters, personas and identities
Studio lets you create characters, personas and reusable identities, including virtual influencers, and use them across generations. When an identity is based on a real person, Studio asks you to record whether you have that person's consent.
Consent in Studio is declared, not verified. Studio records the consent status you enter and when you entered it. It does not verify the identity of the person depicted, confirm that consent was given, or check the scope of that consent. You are responsible for the accuracy of what you declare, and for keeping evidence of the consent you obtained. Misrepresenting consent violates this policy and the Acceptable Use Policy.
You can revoke a consent record in Studio. Revoking it stops the identity from being used for new generations. It does not undo media already created or shared.
Custom models trained on your images
Some models in Studio's catalog support training a custom style or character model from a set of images. Where Studio makes this available, training on images of a real person creates a reusable model of their likeness, so the same consent rules apply as for any likeness: use only images of yourself, or of a person who has explicitly agreed to having a model of their likeness created. Do not train a model on another creator's work in order to imitate their distinctive style or reproduce their works, or on images you do not have the rights to use.
Public figures
Do not create media of public figures, such as politicians, celebrities, executives or other well-known people, that:
- could be mistaken for authentic footage, images, recordings or statements;
- depicts them in sexual or intimate scenarios;
- falsely suggests that they endorse a product, cause or candidate.
Clearly labeled satire, parody and commentary may be lawful, but they must still not be likely to deceive people.
Minors
Do not:
- upload or generate media depicting a real minor without the consent of a parent or legal guardian;
- create media that sexualizes minors in any way, whether real or fictional;
- create a persona or voice based on a real minor.
Content that sexually exploits minors is removed and reported to the relevant authorities where the law requires.
Prohibited synthetic media
Regardless of consent, do not use Studio to create:
- sexual or intimate media of a real, identifiable person without their explicit consent;
- media designed to deceive people about something a real person said or did, including fabricated evidence, fake news footage or impersonation for fraud;
- election or civic disinformation, such as fake statements by candidates or officials, or fabricated depictions of voting, emergencies or public events;
- harassment, defamation or humiliation of a real person;
- content that otherwise violates the Acceptable Use Policy.
Generated content and disclosure
Studio's outputs are AI-generated. When you share them:
- do not present synthetic media of real people as authentic;
- disclose that content is AI-generated where your audience would reasonably expect to know, and wherever the law, a platform's rules or advertising rules require it;
- do not remove or alter disclosures or provenance information attached to Studio exports.
When you export media from Studio, the export can include provenance information describing how the media was created. This information is self-asserted by Ethen and is not cryptographically signed, so it is not a guarantee of authenticity. Some services strip such information when media is uploaded to them.
How Studio processes media
Studio uses third-party providers to generate media:

Providers process these requests under their own terms, which govern how long they keep the data. The Subprocessors list has details. Generated media is returned to Ethen and stored in private storage linked to your project. It is never published to a public location unless you share it.
Before generation, Studio runs automated safety checks on requests to block content that clearly violates this policy. These checks are not perfect. They do not replace your responsibility to follow this policy, and passing them does not mean a use is permitted.
Using Studio output commercially
Before you use Studio output in advertising, products, client work or anything you sell, check the following:
- Model terms. Studio's catalog shows license information for each model where it is known. Some models and providers restrict commercial use, and some catalog entries show that a license is not stated. Check the model's terms before using its output commercially.
- Rights in your inputs. Confirm you have the rights to any uploaded material, brand assets and likenesses the output depends on, for the commercial purpose you intend.
- Disclosure rules. Advertising standards, platform policies and election laws may require disclosure of AI-generated or altered content.
- Rights in the output. Copyright protection for AI-generated material varies by country and may be limited. The Terms of Service explain how rights in Outputs are allocated between you and Upcube.
Sharing and export
- Review links. Studio lets you create links so others can view and comment on your work. Anyone with a review link can view what you shared until you revoke the link. Treat review links like any shared link.
- Downloads and exports. You can download and export media. Once media leaves Studio, Upcube cannot control where it goes. You are responsible for how exported media is used and shared.
Retention and deletion
Studio keeps your projects, generated media, uploads and history until you delete them. Deleted items are removed from your projects and history and marked as deleted; they are not immediately erased from storage. Revoking a review link stops access through that link. Copies a provider received during generation are governed by that provider's terms. The Data Retention Policy has details.
Reporting infringement and misuse
If you believe media created or shared with Studio infringes your copyright or trademark, uses your likeness or voice without consent, or otherwise violates this policy, report it through the contact options in the Legal & Trust Center. Include:
- a link to or description of the content;
- the right you believe is infringed;
- your contact information;
- if you are acting for someone else, your authority to do so.
We may remove content, revoke links, restrict accounts and take the other steps described in the Acceptable Use Policy.
